I think the deal is that if you have the other game's save file on the memory card when you first start SSBM, you get the trophy free. Otherwise, you have to get it like all the rest, through sweat, pain, and randomness.

He should be unlockable by having Mario change into Wario by holding the certain buttons after unlocking the Wario trophy.
