Aren't commercial ROMs still illegal even if you own the cartridge?

I seriously hate to revive an old topic, but where can I get Famtasia?

One more thing. Even if you own the original cartridge, the ROMs are still illegal. The 24-hour delete thing is all just crap. I read about it somewhere.
