I like the logo. Change the font a bit; it's kind of small and hard to read. Maybe put the URL on the back?

He's not actually selling them, so technically he isn't doing anything wrong. Plus SMBHQ has done a similar thing. As long as you're not using copyrighted images on the shirts, I think it's fine to sell them.
